Based on the purchase of a package for and/or participation in travel tours offered by Your Private Europe (“Company”), and in consideration of being permitted to purchase said travel tour, and for other valuable considerations, the receipt and sufficiency of which are acknowledged, the purchaser/participant of the tour (“Participant”) understands, acknowledges, represents, warrants, and agrees as follows, with the knowledge that the Company will rely on the same:

1. The Participant desires to participate in the guided travel tour offered by the Company (“Tour”).
2. The Participant is in good health and does not suffer from any minor or serious physical or mental injuries, illnesses, or disabilities that would make them particularly vulnerable to injuries or disabilities while engaging in any activity contemplated in this Waiver and Release of Claims.
3. The Participant fully understands and accepts all risks associated with their participation in the Tour, including, but not limited to, adverse weather conditions, foodborne illnesses, injuries (e.g., without limitation, arising from self-induced accidents, accidents caused by other participants, vehicles, pedestrians, and the like), and death.
4. The Participant grants the Company an irrevocable and sublicensable right and authority to use the Participant's name, likeness, photograph, and/or image for any and all commercial or non-commercial purposes now known or developed in the future, throughout the universe, without further obligation or compensation to the Participant.
5. THE PARTICIPANT’S PARTICIPATION IN THE TOUR IS AT THE PARTICIPANT’S OWN RISK. THE PARTICIPANT, ON THEIR OWN BEHALF AND/OR ON BEHALF OF ANY PERSON OR ENTITY ACTING THROUGH OR ON BEHALF OF THE PARTICIPANT, HEREBY FOREVER AND UNCONDITIONALLY RELEASES THE COMPANY, AS WELL AS ITS AFFILIATES, PARENT COMPANIES, SUBSIDIARIES, CURRENT AND FORMER OWNERS, MEMBERS, MANAGERS, PARTNERS, CONTRACTORS, INSURERS, SHAREHOLDERS, AND DIRECTORS (INCLUDING, BUT NOT LIMITED TO, ANDY SUHARTONO & PT. MITRAWISATA JELAJAH BUANA) (COLLECTIVELY, THE “RELEASED PARTIES”), FROM ANY AND ALL LIABILITIES, LOSSES, COSTS, AND EXPENSES ARISING IN ANY MANNER FROM OR RESULTING FROM THE PARTICIPANT’S PARTICIPATION IN THE TOUR, INCLUDING, BUT NOT LIMITED TO, ANY AND ALL CLAIMS, ACTIONS, AND LIABILITIES FOR DEATH, INJURY, DAMAGE, OR HARM TO ANY OTHER PERSON, OR TO ANY PROPERTY, EXCEPT FOR SUCH INJURY, LOSS, OR DAMAGE CAUSED BY THE NEGLIGENCE OR WILLFUL MISCONDUCT OF THE COMPANY OR ANY OF THE RELEASED PARTIES. THE PARTICIPANT, ON THEIR OWN BEHALF AND/OR ON BEHALF OF ANY PERSON OR ENTITY ACTING THROUGH OR ON BEHALF OF THE PARTICIPANT, FURTHER AGREES TO DEFEND AND INDEMNIFY THE RELEASED PARTIES, AND TO HOLD THE RELEASED PARTIES HARMLESS, FROM ANY AND ALL LIABILITIES, ACTIONS, DAMAGES, EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) AND LOSSES OF ANY KIND ARISING FROM OR RESULTING FROM THE PARTICIPANT’S PARTICIPATION IN THE TOUR.
6. This Waiver and Release of Claims constitutes the entire agreement and understanding between the Participant and the Released Parties and supersedes, terminates, and replaces any prior agreements or understandings related to the subject matter herein.
7. No provision of this Waiver and Release of Claims may be waived or amended except as expressly signed by the Participant and the party against whom such waiver or amendment is sought. The failure of any Released Party to enforce their rights hereunder at any time shall not act as a waiver of their rights under this waiver and release for similar actions at a later time.
