Waiver and Release of Claims from Your Private Europe

By purchasing a package and/or participating in a guided tour offered by Your Private Europe (“Company”), the Participant agrees to and acknowledges the following terms:

1. The Participant intends to participate in the guided tour offered by the Company (“Tour”).
2. The Participant is in good health and does not suffer from any physical or mental injury that would make the Participant highly susceptible to harm while participating in the Tour.
3. The Participant fully understands and accepts all risks associated with their participation in the Tour, including adverse weather conditions, foodborne illnesses, injuries, and death.
4. The Participant grants the Company an irrevocable, sublicensable right to use their name, likeness, photograph, and/or image for commercial or non-commercial purposes without further obligation or compensation to the Participant.
5. PARTICIPATION IN THE TOUR IS AT THE PARTICIPANT'S OWN RISK. THE PARTICIPANT, ON BEHALF OF THEMSELVES AND/OR ANY PERSON OR ENTITY ACTING THROUGH OR ON BEHALF OF THEM, HEREBY FOREVER AND UNCONDITIONALLY RELEASES THE COMPANY AND ITS AFFILIATES, PARENT COMPANIES, SUBSIDIARIES, CURRENT AND FORMER OWNERS, MEMBERS, MANAGERS, PARTNERS, CONTRACTORS, INSURERS, SHAREHOLDERS, AND DIRECTORS (INCLUDING, WITHOUT LIMITATION, ANDY SUHARTONO & PT. MITRAWISATA JELAJAH BUANA) (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL CLAIMED LIABILITIES, LOSSES, COSTS, AND EXPENSES ARISING OUT OF OR RESULTING FROM THE PARTICIPANT'S PARTICIPATION IN THE TOUR, INCLUDING, BUT NOT LIMITED TO, ANY AND ALL CLAIMS, ACTIONS, AND LIABILITIES FOR DEATH, INJURY, DAMAGE, OR HARM TO ANY PERSON OR PROPERTY, EXCEPT WHERE SUCH INJURY, LOSS, OR DAMAGE IS CAUSED BY THE NEGLIGENCE OR INTENTIONAL MISCONDUCT OF THE COMPANY OR ANY RELEASED PARTY. THE PARTICIPANT FURTHER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL LIABILITIES, ACTIONS, DAMAGES, COSTS (INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES), AND LOSSES OF ANY KIND ARISING OUT OF OR RESULTING FROM THE PARTICIPANT'S PARTICIPATION IN THE TOUR.
6. This Waiver and Release of Claims constitutes the entire agreement and understanding between the Participant and the Released Parties and supersedes any prior agreements or understandings.
7. The terms of this Waiver and Release of Claims may only be amended through a written agreement signed by the Participant and the relevant parties. Failure to enforce any rights does not constitute a waiver of such rights in the future.
